Are Fingerworks products essential public domain now?

From my understanding of trademark law, the Fingerworks brand and logo are unprotected now because they aren't used in the marketplace. Also from my understanding of patent law, any patents required to make any Fingerworks products must have expired by now because they are older than the patent term...

We put the Utilities on an old version of Mandrake using the 2.4 kernel but the result was unchanged. That used the version of Java that shipped with the Utilities.

Thanks for the blog link! That looks very promising, and easier than creating an image, but it begins on a computer that already has the FingerWorks Utilities installed in /Applications/FingerWorks.
